The Employment Relations (Flexible Working) Act 2023 has received Royal Assent, marking a significant milestone for working carers across the UK. This legislation, following on from the Carer’s Leave Act 2023, which received Royal assent earlier this year; will be transformative for the two million workers who also shoulder unpaid caring responsibilities.

Alison Taylor, Chief Executive, Carers First, said, “Supporting unpaid carers in the workplace is vital to the national economy and most importantly to the wellbeing of carers themselves. Taken in conjunction with the Carers Leave Act, the Employment Relations (Flexible Working) Act 2023 will support both employers and carers and help to foster a culture of recognition and understanding in the workplace which is vital if we are to retain skilled staff when they take on a caring role.”

Katherine Wilson, Head of Employment and Specialist Delivery at Carers UK has hailed the Act as a game-changer. "Carers have told Carers UK for years what needs to change so that they feel supported at work and don’t have to give up paid employment, resulting in catastrophic losses of income," she said.

The Act will allow unpaid carers, from the first day of their employment, to request changes to their working hours, times of work, or place of work. This flexibility will be instrumental in helping employees balance work and unpaid care. The ability to request a different flexible working arrangement more than once a year will also be a significant help. Moreover, employees will no longer need to make the case to their employer as to how this could work.
